Disabled and Elderly Sue Pennsylvania to Restore SSI Disability and Retirement Benefits

Community Legal ServicesMore than 359,000 low-income elderly, disabled, and blind Pennsylvanians who are unable to work have filed suit sued against the Pennsylvania Department of Public Welfare in Commonwealth Court to restore their full disability and retirement benefits that were reduced earlier this year without legally required notice and reviews.

This class action lawsuit, Constance Naylor v. Department of Public Welfare, was filed by Community Legal Services, a legal aid law firm in Philadelphia, and Dechert LLP, providing pro bono counsel, and will be heard in Commonwealth Court.

The lawsuit, filed on November 30, alleges that Pennsylvania reduced the plaintiff's State Supplemental Payment without regard to required rulemaking procedures and with only 13 days notice to those affected by the cut.

Pennsylvania Legal Aid Network Comments on New Federal Poverty Data and Mortgage Foreclosure Data

Pennsylvania Legal Aid NetworkYesterday, September 16, 2010, the U.S. Census Bureau released its official 2009 statistics on poverty in this report, Income, Poverty, and Health Insurance Coverage in the United States: 2009.

The Pennsylvania Legal Aid Network (PLAN) notes the report is cause for concern for Pennsylvanians.

Nationally, nearly 57 million Americans are now poor enough to qualify for civil legal assistance. This is an increase of 3 million from 2008. Of the 57 million, 19.6 million were children. In just one year, the national poverty rate increased by a full percentage; from 13.2% in 2008 to 14.3% in 2009. The number of people in poverty in 2009 is the largest number in the 51 years for which poverty estimates have been published. The poverty rate for children rose even more dramatically.

The report reveals that children make up about 35% of the poverty population and people over 65 make up nearly 10% of the poverty population (those at or below 125% of the poverty level).

Also yesterday, RealtyTrac released its report on mortgage foreclosures in Pennsylvania which have increased by 15% over the same period two years ago and compared to one year ago. Pennsylvania’s foreclosure rate is growing at a higher rate than the national increase. “Pennsylvania’s legal aid programs are now reporting a 61% increase in new home ownership and mortgage foreclosure cases for clients facing loss of their homes this year, compared to last year,” said Sam Milkes, Executive Director of PLAN.

The Pennsylvania Bar Association's Legal Services to the Public Committee, in conjunction with the Pennsylvania Bar Institute (PBJ), is presenting its 2012 Pro Bono Conference, Making a Difference: How to do pro bono without it taking over your life (and practice) on May 21, 2012 at the PBI Conference Center in Mechanicsburg.

IRS Seeking Applications for Volunteer Tax Assistance Program Grants

The Internal Revenue Service is accepting applications for the Tax Counseling for the Elderly (TCE) and Volunteer Income Tax Assistance (VITA) grant programs, which will allow some organizations to apply for annual funding for up to three years.

Applications will be accepted only through Grants.gov May 1 through May 31, 2012. Previous grant recipients will have the option to apply for up to three years of annual funding which would reduce the amount of paperwork they must complete over the three-year period. This annual funding will also help recipients with budget planning.

ABA's Celebrate Pro Bono Week Expands to Meet Growing Demand of Nation's Poor

Celebrate Pro Bono!Lawyers have a long tradition of providing pro bono services to Americans in need of legal assistance. For the third successive year, the American Bar Association is coordinating a national strategy to recognize pro bono work done by lawyers every day during its Celebrate Pro Bono Week, October 23-29.

Webinar: Online Intake Best Practices

The Legal Services National Technology Assistance Project and Pro Bono Net will be holding a webinar entitled Online Intake Best Practices on Wednesday, October 12, 2011 from 2:00 pm - 3:30 pm Eastern.

Online intake is the process of taking applications for legal aid services via the web, and it is one of the fastest growing uses of technology in our community. An informal survey by LAWNY earlier this year found 26 programs experimenting with this service via the web. This LSNTAP/PBN Community Training Series webinar will review different online intake implementations as well as their policy and compliance implications.

NLADA Extends Deadline for Nominations for Leadership and Advisory Positions

The National Legal Aid and Defenders Association has extended the nominations period for positions on NLADA's Board of Directors, Civil, Defender and Client Policy Group. Those interested in participating in this process can nominate (or self-nominate) the candidate of your choice by August 19, 2011.

Pro Bono Net will be hosting a national webinar for the community using LawHelp Interactive forms in access to justice projects on May 4, 2011, from 12:00 pm - 1:30 pm Eastern. This webinar will look at designing and creating multilingual templates with a focus on Spanish.
