Explain the New Rules

New rules announced today by the Supreme Court of Pennsylvania clear the way for money left over from class-action lawsuits to help provide legal services for low-income Pennsylvanians.

The new civil procedure rules take effect July 1, directing how money left over from lawsuits after the plaintiffs, attorney fees and expenses have been paid is to be distributed. The residual funds include money for plaintiffs who cannot be located or who don’t file claims.

National Employment Law ProjectLong-term unemployed workers in a growing list of states are being abruptly cut from federal unemployment insurance, a new analysis from the National Employment Law Project shows. Due to reductions Congress enacted earlier this year, more than 400,000 workers in 27 states will have lost between 13 to 20 weeks of federal unemployment insurance under the Extended Benefits program by Saturday, May 12th. The cuts come even though long-term unemployment remains near record highs.

The latest round of cuts that take effect in eight states this Saturday will affect more than 200,000 long-term unemployed workers and account for the biggest number of workers to be hit so far, as states like California, Illinois, Florida, Pennsylvania and Texas are all being phased out at the same time. In California, nearly 100,000 workers are being cut from the extended benefits this week.

Legal Services CorporationThe U.S. House of Representatives approved funding legislation on May 10, 2012 that provides $328 million for the Legal Services Corporation (LSC) in Fiscal Year 2013, after turning back two amendments that would have further cut or eliminated funding for the Corporation.

LSC funding was approximately $404 million in Fiscal Year 2011 before falling to $348 million in Fiscal Year 2012--the lowest funding ever, in inflation-adjusted dollars.

Most of LSC’s funding is used to support local nonprofit organizations via grants for the delivery of civil legal assistance to low-income Americans.

Pennsylvania Health Law ProjectThe Pennsylvania Health Law Project will be offering informational workshops on some important changes in the ACCESS Plus program affecting program participants in Blair, Bedford, Cambria and Somerset counties. These workshops will be held on May 31, 2012 in Blair and Cambria counties.

As of July 1st, 2012, ACCESS Plus will no longer operate in Blair, Bedford, Cambria, and Somerset Counties. These counties will be moved into the HealthChoices Southwest Zone.

In order to educate consumers, families, and advocates in these counties about the upcoming changes, Pennsylvania Health Law Project (PHLP) is holding two training sessions on May 31, 2012 in Blair and Cambria Counties.

Astrue, Commissioner of Social Security, announced on May 1, 2012 that an online version of the Social Security Statement is now available at www.socialsecurity.gov. The new online Statement provides eligible workers with secure and convenient access to their Social Security earnings and benefit information.

The Internal Revenue Service is accepting applications for the Tax Counseling for the Elderly (TCE) and Volunteer Income Tax Assistance (VITA) grant programs, which will allow some organizations to apply for annual funding for up to three years.

Applications will be accepted only through Grants.gov May 1 through May 31, 2012. Previous grant recipients will have the option to apply for up to three years of annual funding which would reduce the amount of paperwork they must complete over the three-year period. This annual funding will also help recipients with budget planning.

Electronic Medical Records Will Reduce Time for a Decision

Visit www.SocialSecurity.govThe Social Security Administration and the Department of Defense (DoD) are working together to improve access to disability benefits for the nation’s Wounded Warriors, service members, veterans, and their dependents. A new nationwide project enables Social Security disability case processing sites to receive military medical records from multiple DoD facilities with a single request to a centralized DoD site. As of today, this initiative is in its first phase of nationwide expansion.
